ORDINAL AI Terms and Conditions (“Terms”)

Acceptance

By using our products and services, you indicate that you accept our Terms of Use. Please read these Terms of Use carefully before accessing or using ORDINAL AI products and software services, which are provided by ORDINAL AI (“Company”).

By accessing or using the ORDINAL AI products, you agree to be bound by all of the Terms, inclusive of any future modifications or additions. If you do not agree to all of the Terms, then you may not access or use the products.

Age Restriction

You must be 18 years of age or older to access or use the ORDINAL AI products. We do not allow/promote users to use our NSFW image AI to produce illegal imagery like Sexual Minor /Dangerous/Hate/Misuse imagery. Individuals attempting to train/trick the AI into producing such content will be flagged by our systems and will be reported and removed from our platform permanently. By accessing or using the Products, you represent and warrant that you are 18 years of age or older and that you agree to abide by all of the terms and conditions of these Terms.

Content

You understand that ORDINAL AI products generate images and texts which may contain content deemed as Not Safe For Work (NSFW) or any Non-PC content. You agree to be responsible for any such content and understand that ORDINAL AI is not responsible for any content created or accessed through its Services.

Intellectual Property Rights and Licenses

All logos, software, and services used in connection with the ORDINAL AI products are the exclusive property of ORDINAL AI and/or its licensors and are subject to copyright and other intellectual property rights. No part of this content may be copied, duplicated, modified, republished, uploaded, posted, transmitted, or distributed in any way for commercial use without obtaining prior written consent from ORDINAL AI. Generated imagery and Outputs can be owned/shared for commercial use in the event that you have a current paid plan with ORDINAL AI.

You may not use ORDINAL AI products for any illegal purpose, or in violation of any applicable domestic or international laws, including copyright and other intellectual property rights. You are solely responsible for your conduct while using the products, and you will indemnify ORDINAL AI and its affiliates against any harm, claims, or damages resulting from your use of the products, or violation of any applicable law or the Terms.

No Warranties

ORDINAL AI makes no warranties or representations about the accuracy or completeness of any content generated or made available through its services and products. The company disclaims all warranties, either express or implied, statutory or otherwise, regarding the products, including without limitation any warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Limitation of Liability

ORDINAL AI shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages, losses, costs, or expenses resulting from the use of the products, even if ORDINAL AI has been advised of the possibility of such damages.

Termination

You may terminate your use of the products at any time, in accordance with the Terms of Use. ORDINAL AI may also terminate or suspend your access to the products, with or without notice and in its sole discretion, should it find any breach of these Terms.

Violations and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of [America] without giving effect to any principles of conflicts of law. You agree to submit to the personal jurisdiction of the state and federal courts located within [the United States & international Laws] and waive any jurisdictional, venue, or inconvenient forum objections to such courts.

In the case of any violation of these Terms, ORDINAL AI reserves the right to seek all remedies available by law and in equity for such violations.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

These Terms constitute the entire agreement between you and ORDINAL AI relating to the subject matter herein and supersede any prior agreements between you and ORDINAL AI.
